These Terms of Service ("Terms") govern your access to and use of our platform, including all AI-powered music generation services, Sound Space marketplace, games, sounds, and features provided by Warbls Inc. ("we," "us," or "our"). By creating an account or using Warbls, you agree to these terms. If you do not agree, you must refrain from using the platform.

1. Acceptance and Eligibility

You must be at least 13 years old to use Warbls. Users under 18 must have parental consent. By using our services, you represent that you meet these age requirements and have the legal capacity to enter into these Terms.

2. Account Registration and Security

Users are responsible for maintaining the security of their accounts and for all activities conducted through their accounts. You agree to:

Provide accurate and current information during registration
Maintain the confidentiality of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

3. AI-Generated Content and Ownership

Your Generated Music: All tracks you create using Warbls AI are 100% royalty-free and yours to use commercially. You can release them on streaming platforms, sell beats, use in videos, or any other creative project. You keep all revenues.

Commercial Rights: You get full commercial rights to all songs created with an active subscription. Just make sure you use original lyrics, and if you upload or extend a sound, ensure it's your own creation or a sound from Warbls.

Copyright Notice: Please note that AI-generated music may not qualify for copyright protection in certain jurisdictions, as copyright law typically requires human authorship. While you have full commercial use rights to your generated tracks, the underlying AI-generated composition may not receive copyright protection. If you provide custom lyrics, you retain ownership and potential copyright protection for those lyrics.

Sound Fusion: Warbls offers an exclusive Sound Fusion feature that allows you to blend professional loops unlocked from crates directly into your AI generations. This creates hybrid tracks combining real, handcrafted instruments with AI composition. All tracks created using Sound Fusion maintain the same commercial rights and royalty-free status as standard AI-generated content.

Generated Lyrics Disclaimer: Warbls provides AI-generated lyrics as a creative tool. We are not responsible for the content, accuracy, or appropriateness of generated lyrics. Users must review and verify all lyrics before use. You are solely responsible for ensuring lyrics don't infringe on copyrights, contain inappropriate content, or violate any laws.

Crate Sounds: All sounds you win from crates are 100% royalty-free and can be used in your commercial projects. Mix them, chop them, transform them into your productions. However, you cannot resell or redistribute these sounds as standalone assets or sample packs.

Sound Space Marketplace:

For Sellers: When you sell a track on Sound Space, you transfer all rights to that specific audio file to the buyer. You cannot use, resell, or distribute that exact audio file anymore. However, you retain rights to the underlying composition and can create new versions.

For Buyers: When you purchase a track on Sound Space, you receive 100% ownership of that audio file. You can use it commercially, modify it, resell it, include it in your productions, or do anything you want with it. It's completely yours.

4. Services and Features

Free Tier: Access to limited AI generations, skill-based games, and basic features through our mobile and web applications.

Subscription Plans: We offer multiple subscription tiers (Starter, Pro, Studio) with varying amounts of coins, AI generations, and features. Prices and details are available on your account page. Pro monthly subscriptions include a 50% discount for the first month (pay just $12 for the first month, then $24/month after that).

Virtual Currency: Coins earned through gameplay or purchased can be used to open crates or access premium content. Coins have no cash value and cannot be withdrawn or transferred. Coins and generations can accumulate and stack month-to-month while you maintain an active subscription. However, if you unsubscribe, all coins and generations will be removed after your billing period ends.

5. Acceptable Use Policy

You agree not to:

Resell Warbls sounds as sample packs or standalone products
Share your account or transfer coins between accounts
Use bots or scripts to farm coins or abuse the system
Upload copyrighted material you don't have rights to
Generate content promoting violence, hate, or illegal activities
Attempt to hack, reverse engineer, or exploit our AI
Create multiple accounts to abuse promotions or discounts

6. User Content and Submissions

When you upload content to Sound Space or community features, you:

Retain all ownership rights to your original content
Grant us a limited license to display and distribute your content on the platform
Warrant that you have all necessary rights to the content
Agree that we may moderate or remove content that violates our policies

Content sold on Sound Space is subject to our marketplace terms and revenue sharing model.

7. Payment Terms

Promotional Discount: New Pro monthly subscribers receive a 50% discount on their first month. This is a one-time promotional offer applied automatically at checkout. Standard pricing applies after the first month.

Monthly Subscriptions: Auto-renew each month. You may cancel anytime through your account settings. Cancellations take effect at the end of the current billing period, and you'll retain access until then.

Annual Subscriptions: Billed yearly with no refunds for partial periods. When you choose annual billing, you commit to the full year. Annual plans offer significant savings but are non-refundable once purchased.

Coin Purchases: All coin purchases are final and non-refundable.

Payment Processing: We use Stripe for payment processing. By making purchases, you agree to Stripe's terms of service.

8. Intellectual Property

All platform content, including our AI models, website design, logos, and proprietary technology, is owned by Warbls Inc. and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our service except as explicitly permitted.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

10. Indemnification

You agree to indemnify and hold Warbls harmless from any claims arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules. Class actions are waived.

12. Termination

We may suspend or terminate your account for violations of these Terms. Upon termination, your right to use the service ceases immediately, but generated content you've already downloaded remains licensed to you.

13. Changes to Terms

We may update these Terms at any time. We'll notify you of material changes via email or platform notification. Continued use after changes constitutes acceptance.
